OFFICIAL HOA STATEMENT

ATTENTION ALL RESIDENTS:
We have received communication concerning a homeowners meeting held by resident(s) in regard to HOA legal enforcement business and dues on March 9, 2024 @ 12:30pm.  This is not an official HOA meeting. All homeowner's must do their due diligence in regard to signing any un-clarified petition as certain residents(s) have communicated to our HOA attorney that they are trying to remove the current HOA board possibly to benefit their current legal enforcement case(s).  Why?!! 

Facts that we can currently share with you are as following:

  • The HOA is not raising annual dues.

  • The HOA will defend against any suit - The community and board is insured and so is each board member.

  • The HOA will seek legal enforcement on any default, ACC, or code violating homeowner if and only when all communication from the HOA is blocked or ignored.  This is the last resort of action. All homeowners had a whole year of flyer and mail communication before any legal action or liens were even considered or enforced upon.

  • HOA enforcement steps: First, all homeowner verbal and written communication(s) from the HOA are ignored with no efforts for any resolution.  Second, a certified letter from HOA attorney is then sent out to homeowner with a 30 day window to resolve. Finally, a legal case is ensued.

  • The HOA will use all power necessary to enforce the covenants of this community - it's our duty.  We did not write them and are not violating any homeowner's or civil rights.

With this information, if you signed an un-clarified community based petition for reasons other than the removal of the current HOA board, please ask that your name be removed immediately from the petition or send us an email to: fowhoa@gmail.com to be added to our support/proxy list, if needed.  Many residents have notified us that they want their names removed from the 'petition' due to the misinformation - such as examples: open meeting, broken gate issues, street repair, misappropriation of funds, security, the raising of dues, homeowner's rights, etc.
If you signed the un-clarified petition and are a tenant, your signature or vote is void just as any 
homeowner with a current default of your annual assessment (any levied balance or lien) - we (the HOA Board) had to suspend any and all membership voting rights of those residents until assessments have been paid in full per FOW covenants /bylaws:

Bylaws - Article Three - Section 3.

Please understand that all of these particular resident actions and reactions against the current HOA board members are all related to any legal cases pending of the enforcement of the covenants / bylaws or legal defense.

Ask questions, research, and demand facts of these resident(s) who are soliciting the community, wasting our time and funds in their 'fight' against the HOA with no solid facts or reasoning to do so.  We, the HOA board, are volunteers of our time with a duty to protect this private community, it's standards, and values.  This type of behavior of certain residents who want to run this community and who do not even comply or respect our covenants/bylaws will not be tolerated and it's not fair to those, the majority of the responsible residents who pay their dues in a timely manner (or through a payment plan) plus follow all the rules of the community.

The HOA will continue to stand firm, be fair, and enforce fully.  We must unite and support each other to save this community!
